3. Definitions

The Site presents and allows users to request photography, inspection, and survey services using drones,
as well as related services (quotes, sales contact, information). The actual services are subject to a separate written contract between INTELLINSKY and the customer.

4. Access to the Site

The Site is accessible 24 hours a day except during maintenance, updates, or force majeure. INTELLINSKY strives to ensure continuous access, but does not guarantee uninterrupted access or the absence of errors.

5. Account and security

Certain sections or features of the Site may require the creation of an account. You are responsible for the confidentiality of your login details and for all activities carried out under your account. You must immediately inform INTELLINSKY of any unauthorized use.

6. Description of services and reservations

Any request for services (quote, contact) made via the Site is a simple request.
Written confirmation (signed quote, purchase order, contract) is required to formalize the service.
Quotes are valid for the period indicated on the document. Response times are
provided for informational purposes only and may vary depending on administrative authorizations, weather conditions, or technical constraints. INTELLINSKY handles the administrative procedures related to flights (prefectural declarations, authorization requests, S3 protocols, etc.) unless otherwise specified in the contract.

7. Regulations, safety, and customer responsibilities

Services are provided in accordance with current French and European aviation regulations.
Our remote pilots are certified and our fleet is approved.
The Customer undertakes to provide INTELLINSKY with all information necessary for the execution of the mission (site plan, contact details, access authorizations, security constraints, sensitive presences, etc.).
The Customer is responsible for obtaining, where applicable, the necessary authorizations from third parties (private owners, event organizers, local authorities) to enable the mission to be carried out.
In the event of non-compliance by the Client with authorization or security obligations, INTELLINSKY reserves the right to suspend or cancel the assignment. The costs and damages resulting from such a breach shall be borne by the Client.

8. Intellectual property and right to use deliverables

Unless otherwise specified in the contract, INTELLINSKY retains copyright over the images, videos, data, and technical deliverables provided to the Client.
INTELLINSKY grants the Client a non-exclusive, non-transferable license limited to the use specified in the quote/contract (e.g., promotional use, internal use, distribution). Any additional use (resale, transfer of rights, commercial use outside the contractual framework) requires written authorization and may be subject to additional charges.
The Client undertakes not to alter the authorship of the works and to respect any references and credits that may be requested.

9. Confidentiality and personal data

The terms and conditions for processing personal data collected via the Website are specified in our Privacy Policy. By using the Website, you consent to the processing of your data as described in this policy.
INTELLINSKY implements appropriate technical and organizational measures to protect data. However, in the event of loss or unauthorized access, INTELLINSKY shall only be liable under the conditions provided for by law and the contract.

10. Cookies

The Site uses cookies to improve the user experience. You can manage your preferences via the consent banner or your browser.

11. Rates, billing, and payment

Rates are indicated in quotes or contracts. Applicable taxes are added where applicable.
The payment terms (deposits, due dates, late payment penalties) are those stipulated in the quote/contract. Unless otherwise specified, invoices are payable within 30 days net.
In the event of late payment, interest and collection costs may be applied in accordance with the law.

12. Cancellation and postponement

The conditions for cancellation, postponement, and refund are specified in the quote/contract. Fees may apply depending on the costs incurred and the notification period.
In the event of impediments related to weather conditions or airspace restrictions, INTELLINSKY will propose a postponement date or a partial refund in accordance with the contractual terms.

13. Limitation of Liability

To the extent permitted by law, INTELLINSKY’s liability to the User or Customer for any direct damages shall be limited to the total amount invoiced for the service concerned.
INTELLINSKY shall not be liable for any indirect damages, loss of profit, loss of earnings, or damages caused by third parties or due to circumstances beyond its control.

14. Force Majeure

INTELLINSKY shall not be held liable in the event of partial or total non-performance of its obligations caused by an event of force majeure (natural disasters, war, strikes, administrative decisions, airspace restrictions, supplier failures, etc.).

15. Modification of the Terms of Use

INTELLINSKY reserves the right to modify these Terms of Use. Modifications will be published on the Site with an update date. Continued use of the Site constitutes acceptance of the new Terms of Use.

16. Applicable law and jurisdiction

These Terms of Use are governed by French law. In the event of a dispute, the parties will first seek an amicable solution. In the absence of an agreement, the competent courts will be those within the jurisdiction of INTELLINSKY’s registered office, unless otherwise required by law.
